mas não sem esperança.

Sunstein on Regulatory Reform

Few people who served in the Obama Administration or are professors at Harvard Law School praise the Trump Administration for anything, but Cass Sunstein is commending the Trump Executive Orders on regulatory reform. Sunstein writes:

The [new executive] order calls for the official designation of “Regulatory Reform Officers” and “Regulatory Reform Task Forces” within each department and agency of the federal government.

The reform officers are charged with carrying out three earlier executive orders. The first is Trump’s own requirement that agencies eliminate two regulations for every one that they issue. More surprisingly, the second and third come from Presidents Bill Clinton and Barack Obama. The Clinton order, issued in 1993, requires cost-benefit analysis of new regulations, along with approval by the Office of Information and Regulatory Affairs.

The 2011 Obama order calls for “retrospective review” of existing regulations, with the goal of getting rid of those that don’t make sense. By requiring adherence to the Clinton and Obama orders, the Trump administration has signaled a degree of continuity with what came before. That’s a good idea.

It is interesting how Sunstein frames these reforms. Unlike the mainstream media, Sunstein emphasizes the continuity with the past. I am sure that many right wing observers also doubt that the Trump Administration will have continuity with the Obama Administration. But Sunstein makes the argument nonetheless.

I agree with Sunstein that there is much to be said for these task forces. In fact, I myself advocated the enactment of a permanent administrative agency with the authority to repeal exist regulations. I have also recommended that there be officers in each agency with the primary responsibility of identifying regulations that should be repealed, officers who would work with the deregulatory agency.

I hope that the Trump Administration can build on these executive actions and turn them into legislative reforms, such as creating the deregulatory agency. But the filibuster rule probably stands in the way.

It no doubt took some courage for Sunstein to praise the Trump Administration in print. But Sunstein does stand up for his principles. By many accounts, he was not a terribly popular man in the Obama Administration, since he blocked various regulations by agencies such as the EPA. Yet, he was able to accomplish much, because he was said to have the confidence of the President.


Professor Rappaport is Darling Foundation Professor of Law at the University of San Diego, where he also serves as the Director of the Center for the Study of Constitutional Originalism. Professor Rappaport is the author of numerous law review articles in journals such as the Yale Law Journal, the Virginia Law Review, the Georgetown Law Review, and the University of Pennsylvania Law Review. His book, Originalism and the Good Constitution, which is co-authored with John McGinnis, was published by the Harvard University Press in 2013. Professor Rappaport is a graduate of the Yale Law School, where he received a JD and a DCL (Law and Political Theory).

Qual a diferença entre virtudes teologais e virtudes morais?

A palavra "virtude" é usada como um sinônimo para "bondade" ou "sobriedade" ou algo parecido com um traço de personalidade, mas a Igreja emprega esse termo de uma forma muito mais precisa. As virtudes são graças especiais dadas por Deus à alma para a realização de certos objetivos. Elas são inerentes à alma e estão sujeitas ao fortalecimento ou enfraquecimento. A Igreja distingue duas categorias gerais de virtudes: teologais e morais.

Fé, esperança e caridade são as chamadas "virtudes teologais" porque são as mais importantes características na vida cristã, como Paulo explica em Romanos 5,1-5 e 1Coríntios 13,13. Elas se referem (exclusivamente no caso da fé e esperança, e primariamente no caso da caridade) à relação de alguém com Deus.

"Fé" é a graça de crer no amor de Deus por nós e em suas verdades reveladas (Lucas 1,45; João 11,25-26; Efésios 2,8). "Esperança" é a graça de confiar que Deus cumprirá com a sua promessa de nos salvar da morte eterna se nos voltarmos a Ele em arrependimento (Romanos 5,2; 8,25; Hebreus 6,17-20; 1Pedro 1,3-5). "Caridade" é uma graça de duplo-efeito: o efeito primário é o de mover a vontade de amar a Deus fervorosamente e acima de todas as coisas; o efeito secundário é o de intensificar o nosso amor ao próximo (Deuteronômio 6,4-6; Mateus 22,36-40; 25,31-46; Marcos 12,28-31; Romanos 13,8-10; 1Coríntios 13,1-13).

"Virtudes morais" são assim chamadas porque elas nos ajudam a viver dentro dos parâmetros morais estabelecidos pelo Evangelho. As principais delas são: a prudência, a justiça, a temperança e a fortaleza, também conhecidas como "virtudes cardeais" (derivado do latim "cardo", que significa "dobradiça", porque sobre elas dependem todas as outras virtudes morais).

A "prudência" é a graça de formar julgamentos corretos (Mateus 10,16; 1Pedro 4,7). A "justiça" nos ajuda a lidar de forma equitativa com os outros (Provérbios 21,21; 1Timóteo 6,11). A "temperança" nos ajuda a subjugar os nossos apetites sensuais e fazer uso adequado das criaturas de Deus (1Coríntios 6,12; 10,23-24). A "fortaleza" nos ajuda a perseverar [na fé e no bem] apesar das tentações do pecado e do desespero (Romanos 8,32-35; Tiago 5,10-11). Outras virtudes morais são: humildade (Mateus 18,1-5), paciência (Hebreus 10,36-37), obediência (Romanos 13,1-7), castidade (1Coríntios 6,15-20), piedade (Efésios 5,15-20) e veracidade (Efésios 4,15.25).

Abstract

This essay examines the role of “critical spectatorship” in the writings of two distinguished European intellectuals, José Ortega y Gasset (1883-1955) and Raymond Aron (1905-1983). For all of their differences, the two thinkers belonged to the same spiritual family, that of European liberalism broadly defined, a common cultural and political universe placing special emphasis upon individual liberty, dignity, and human excellence. We begin the paper by commenting on the struggle between civilization and barbarism, a fundamental topic in Ortega and Aron’s writings. Preserving the values of civilization was one of the main reasons for their involvement in the public life of their countries. Next, we turn to the concept of “critical spectatorship” central to their writings and comment on the similarities and differences between their visions on this issue. We conclude by drawing a few conclusions on the relevance of Ortega and Aron’s types of social and political criticism for us today.
